Right of withdrawal

You may withdraw from this contract within 14 days without giving any reason in writing (e.g., letter, fax, email) or—if the goods have been delivered to you before the end of this period—by returning the goods.

The period begins upon receipt of this notification in writing, but not before the goods have been received by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before fulfillment of our information obligations pursuant to Article 246 § 2 in conjunction with § 1 paragraphs 1 and 2 EGBGB (Introductory Act to the German Civil Code) as well as our obligations pursuant to § 312g paragraph 1 sentence 1 BGB (German Civil Code) in conjunction with Article 246 § 3 EGBGB.

To comply with the withdrawal period, it is sufficient to send the withdrawal notice or the goods in good time.

Consequences of revocation

In the event of an effective withdrawal, the services received by both parties must be returned and any benefits derived (e.g., interest) must be surrendered. If you are unable to return or surrender the services received (e.g., benefits of use) to us, either in whole or in part, or only in a deteriorated condition, you must compensate us for the loss in value. You only have to pay compensation for the deterioration of the item and for any benefits derived if the use or deterioration is due to handling of the item that goes beyond checking its properties and functionality. “Checking the properties and functionality” means testing and trying out the respective goods, as is possible and customary in a retail store. Items that can be shipped by parcel post are to be returned at our risk. You shall bear the regular costs of the return shipment if you have not yet rendered the consideration or a contractually agreed partial payment at the time of revocation. Otherwise, the return shipment is free of charge for you. Please contact us and we will send you a return shipping label. Items that cannot be shipped by parcel post will be picked up from you. Obligations to refund payments must be fulfilled within 30 days.

The period begins for you with the dispatch of your revocation declaration or the item, for us with its receipt.

End of cancellation policy

Cost bearing agreement

If you exercise your statutory right of withdrawal (see Section XI above), you shall bear the regular costs of returning the goods if you have not yet provided the consideration or made a contractually agreed partial payment at the time of withdrawal. In all other cases, the return shipment is free of charge for you.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to distance contracts

for the delivery of goods that are manufactured according to customer specifications or clearly tailored to personal needs or that are not suitable for return due to their nature or that can spoil quickly or whose expiration date would be exceeded (e.g., perishable food);
for the delivery of audio or video recordings or software, provided that the delivered data carriers have been unsealed by the customer;
which involve the delivery of goods whose price is subject to fluctuations on the financial market (e.g., gold) over which we have no influence and which may occur within the withdrawal period.

Applicable law

German law applies exclusively. With regard to consumers, this choice of law applies only insofar as it does not restrict any mandatory legal provisions of the country in which they have their domicile or habitual residence.
The contract language is German.
If our customer is an entrepreneur, the place of performance and jurisdiction for all deliveries is our company headquarters.
